📜 General Terms and Conditions of Sale

1. General Provisions

1.1

These General Terms and Conditions of Sale govern the contractual relationship between AFANAYA EI, whose registered office is located at 13 Rue Albert Schweitzer, 61000 Alençon, France, registered with the Trade and Companies Register of Alençon under number 820 176 048, as the seller and operator of the online store www.afanaya.fr, and any individual or legal entity making a purchase, hereinafter referred to as the “Customer”.

1.2

These terms apply uniformly to all customers, whether private consumers or professionals.

1.3

They primarily govern the sale of products via our e-commerce website www.afanaya.fr, and also apply to orders placed by phone through our customer service.

2. Formation of the Sales Contract

2.1

The Customer may enter into a distance sales contract with AFANAYA EI either by placing an order on the online store or by contacting our customer service by phone.

2.2

An order placed online or by phone constitutes an offer to contract, valid for a period of 7 days. An acknowledgment of receipt is sent by email.
The sales contract is only finalized upon acceptance of the order by AFANAYA EI and shipment of the goods. A shipping confirmation is then sent to the Customer by email.

2.3

Products are offered in quantities corresponding to normal household use. In certain cases (e.g., promotions or stock clearance), AFANAYA EI reserves the right to limit the number of items per customer.

2.4

The order is deemed confirmed when the Customer clicks the “Order” button. Order details and these terms are retained for 5 years.
In case of an error, the Customer may correct the order via their account or order form before shipment.

3. Right of Withdrawal

3.1

In accordance with applicable law, the Customer has a 14-day right of withdrawal from the date of receipt, without having to provide a reason.
As a commercial gesture, AFANAYA EI extends this period to 90 days from the delivery date.

3.2

3.3

If withdrawal is exercised within 14 days, AFANAYA EI will refund the product price and the standard delivery cost.
If exercised between 14 and 90 days, only the product amount will be refunded.
Refunds are processed within a maximum of 14 days, using the original payment method.

3.4

Products must be returned within 14 days after withdrawal notification to:

If a free gift was included, it must also be returned. Otherwise, the refund may be delayed.
Return shipping costs are borne by the Customer unless stated otherwise.

3.5

The Customer is responsible for any loss in value resulting from handling beyond what is necessary to establish the nature and functioning of the product.

The following items cannot be returned:

  • Personalized products (e.g., custom packaging)

  • Opened products that cannot be resold for hygiene or health reasons (e.g., cosmetics)

  • Gift wrapping or eco-packaging services once performed

4. Claims and Warranty

4.1

If a product is delivered damaged or defective, the Customer may request compensation in the form of a credit note, replacement, or refund.
If repair or replacement is not possible, a price reduction or contract cancellation may be requested.

4.2

AFANAYA EI provides a 2-year warranty from the delivery date, or until the product’s expiration date if earlier.

4.3

A product is considered defective if:

  • It does not meet expected quality or functionality

  • It does not comply with legal requirements

  • It is delivered in incorrect quantity

4.4

The following are not considered defects:

  • Personal sensitivities or allergic reactions

  • Absence of a free gift not explicitly included

  • Minor packaging differences due to manufacturer updates

5. Payment and Delivery Terms

5.1

Customers may choose from available payment and delivery options at checkout. Orders are processed only after full payment is received.

5.2

Available payment methods, delivery options, and any applicable fees are indicated at checkout.

5.3

Delivery times are estimates based on carrier information and may vary.

5.4

In certain cases, AFANAYA EI may offer free delivery at its discretion.
